The Government of Puerto Rico recently enacted a law that provides that all birth certificates issued in Puerto Rico prior to July 1, 2010 are invalid effective July 1, 2010. The new law was meant to reduce the fraudulent use of Puerto Rico-issued birth certificates.
The law does not invalidate any ‘action’ initiated using a birth certificate issued before July 1, 2010 and the Government of Puerto Rico extended the validity of current Puerto Rico birth certificates for three months, from July 1, 2010 through September 30, 2010, to give people additional time to obtain a new, more secure birth certificate. The Government of Puerto Rico started to issue new, security enhanced birth certificates beginning July 1, 2010.
FOR YOUR INFORMATION, THE LAW’S GENERAL EFFECT ON NYCHA’S APPLICANTS AND RESIDENTS IS:
- For persons born before July 1, 2010 (his/her birth certificate was issued by the Government of Puerto Rico prior to July 1, 2010):
- If the birth certificate was already submitted to NYCHA (with an application for housing, as a result of an eligibility interview, a Section 8 briefing or at the request of development management) or will be submitted to NYCHA before October 1, 2010, it will be considered valid.
- If the birth certificate will be submitted to NYCHA on or after October 1, 2010, it will NOT be considered valid. A new birth certificate issued by the Government of Puerto Rico on or after July 1, 2010 will be required.
- For persons born on or after July 1, 2010 (his/her birth certificate was issued by the Government of Puerto Rico on or after July 1, 2010): the birth certificate will be considered valid. These will be the new security enhanced birth certificates.
